These Terms & Conditions ("Terms") govern your use of the POPIAReady website at popiaready.co.za (the "Service") operated by POPIAReady ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Service Description

POPIAReady provides an online document generation tool that creates legal document templates based on information you provide. These templates are designed to help South African businesses address common legal requirements including those under the Protection of Personal Information Act (POPIA).

3. Important Disclaimer - Not Legal Advice

POPIAReady is not a law firm and does not provide legal advice. The documents generated by our Service are templates based on common legal frameworks and the information you provide. They are designed to help you meet common legal requirements but are not a substitute for professional legal counsel.

We strongly recommend that you have all generated documents reviewed by a qualified South African legal professional before publishing them on your website or relying on them for compliance purposes.

We do not guarantee that any document generated by our Service will make you fully compliant with POPIA, the Consumer Protection Act, the ECT Act, or any other legislation. Compliance depends on many factors specific to your business that automated document generation cannot fully address.

4. Pricing and Payment

Our Service offers a free preview of generated documents. To download documents without watermarks, payment is required at the prices listed on our pricing page.

• All prices are listed in South African Rands (ZAR) and include VAT where applicable
• Payments are one-time purchases, not subscriptions
• Once purchased, you may regenerate and download your documents unlimited times

5. Refund Policy

Due to the digital nature of our products, refunds are generally not available once documents have been downloaded. However, if you experience technical issues that prevent you from accessing your purchased documents, please contact us within 7 days of purchase at support@popiaready.co.za and we will resolve the issue or provide a refund.

6. Intellectual Property

The POPIAReady website, branding, and document generation algorithms are our intellectual property. However, once you purchase and download documents, you own full rights to use, modify, and publish those documents on your own website or for your own business purposes.

You may not resell generated documents as a competing service or white-label our generator without written permission.

7. User Responsibilities

When using our Service, you agree to:

• Provide accurate and truthful information about your business
• Review generated documents before publishing them
• Not use the Service for any unlawful purpose
• Not attempt to reverse-engineer or copy our document generation system
• Seek professional legal advice for complex or high-risk compliance matters

8. Limitation of Liability

To the maximum extent permitted by South African law, POPIAReady shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including but not limited to:

• Fines or penalties imposed by the Information Regulator or any other authority
• Claims by third parties arising from your privacy practices
• Loss of business, revenue, or data
• Any legal proceedings resulting from use of generated documents

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid for the Service.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
